California "Right to Repair" Home Buyer Contract Clause

The above referenced sections describe a process in California which generally applies to homes built after January 1, 2003, but only if the builder/developer opts into the procedures created by the California State Legislature.

First time homeowners may see a reference to SB800 Civil Code §895 et seq. or the phrase “right to repair” in their purchase contracts.

Unfortunately, the purchase contracts are also filled with a number of other procedures that frankly the builders/developers often use to confuse and intimidate home buyers who subsequently have problems.

Home buyers in California generally have ten years from the date that the house is completed in order to present claims for construction defects. These rights apply whether it’s the first owner, the second owner or a subsequent owner who buys a house out of foreclosure. It is the ten year period that is important.
